4. Customer Responsibilities: Permits & Underground Utilities

The Customer is solely responsible for the following before work begins:

1. Permits. Obtaining, paying for, and complying with all permits, approvals, and inspections required by any city, county, state, or other governing authority, homeowners’ association, or other party for the work described in this Agreement.
2. Underground utilities. Locating and clearly marking all underground utilities and facilities on the property, including contacting Sunshine 811 (call 811) within the time required by Florida law before any digging begins.
3. Private lines. Identifying and marking all private underground lines and structures that 811 does not locate, including but not limited to septic tanks and drain fields, wells, irrigation and sprinkler lines, private water, gas, and electric lines, and buried cables.
4. Property lines. Identifying property boundaries and survey markers for the work area.

5. Hold Harmless & Indemnification

To the fullest extent permitted by law, the Customer agrees to indemnify, defend, and hold harmless Dunbar Excavation Services, its owner, employees, and agents from and against any and all claims, damages, losses, fines, penalties, liabilities, and expenses arising out of or related to: (a) the absence of, failure to obtain, or failure to comply with any required permit, approval, or inspection; and (b) any underground utility, line, pipe, cable, tank, or structure that was not located, was improperly located, or was not clearly marked before work began, including damage to such utilities and any resulting repair costs, service interruptions, or claims by utility owners or third parties.

This obligation includes reasonable attorney’s fees, court costs, and other expenses incurred by Dunbar Excavation Services in defending against any such claim or in enforcing this hold harmless provision, whether incurred before suit, at trial, or on appeal.

6. Payment Terms

Payment is due upon completion of services unless otherwise agreed to in writing prior to the start of work. The customer agrees that any unpaid balance becomes immediately due and payable upon completion of the contracted services.

7. Non-Payment & Remedies

In the event payment is not received when due, Dunbar Excavation Services reserves the right to pursue all remedies available under Florida law, including collection costs, attorney’s fees where permitted by law, and any applicable lien rights.

8. Marketing & Photography Release

Customer grants Contractor permission to photograph, video record, and otherwise document the project before, during, and after completion for marketing, advertising, portfolio, website, social media, training, and promotional purposes.

Contractor agrees not to publish, disclose, or share any personally identifiable information (PII), including but not limited to customer names, phone numbers, email addresses, financial information, government-issued identification numbers, or exact street addresses. Any photos or videos used for promotional purposes will focus on the work performed and may be edited to remove identifying information when necessary.

Customer understands that project images and videos may be displayed on Contractor’s website, social media accounts, advertisements, printed materials, and other marketing channels without additional compensation.

9. Acceptance

By signing below, the Customer and Contractor agree to the terms of this Agreement, including the services and pricing listed above and the Marketing & Photography Release in Section 8.
